FAMILY MIGRATION

The family stream of Australia's
Migration Program provides an opportunity for Australian citizens, Australian
permanent resident and Eligible New Zealand citizens to reunite in Australia with
their close family members eg. spouse, fiancé(e)s interdependent partners,
dependent children and adopted children. Others include other family members
such as parents, orphan relatives, carers, aged dependent relatives, and
remaining relatives.
Aged dependent relative
An aged dependent relative is a person who is old enough to be granted an
Australian age pension, who is single and remains dependent on an Australian
relative. Qualifying age for men is 65 while for women the age is gradually
being increased from 60 to 65.
The sponsoring relative in Australia
must be a child, adopted child, parent, brother or sister, grandchild, uncle or
aunt, niece or nephew (or step-relative equivalent) of the applicant.
Sponsored Aged dependent relative must prove that they are wholly or
substantially dependent on the sponsoring Australian relative for financial
support for their basic necessities. They must be supported by the sponsor over
a reasonable period (normally three years).
Remaining relative
A remaining relative is a person who has no close family ties outside Australia and is the brother, sister, child or
step equivalent of an Australian citizen, Australian permanent resident or
eligible New Zealand
citizen.
The applicant and spouse (if any) must not have any close relatives in any
country apart from Australia.
A near relative is a parent, sibling, non-dependent child or their step
equivalent.
A person who has previously been granted a Subclass 104 (Preferential Family)
visa, Subclass 115 (Remaining Relative) visa, Subclass 806 (Family) visa or
Subclass 835 (Remaining Relative) visa cannot sponsor an applicant for a
remaining relative visa. A person who has previously sponsored a successful
applicant for a Subclass 104 (Preferential Family) visa, Subclass 115
(Remaining Relative) visa, Subclass 806 (Family) visa or Subclass 835
(Remaining Relative) visa cannot sponsor another person for a Remaining
Relative visa.
Carer
A carer is a person willing and able to give substantial, continuing and direct
assistance to an Australian relative (or member of their family unit) who has a
medical condition that impairs their ability to attend to the practical aspects
of daily life.
An Australian relative may be the spouse of the person, or child, adopted
child, parent, brother or sister, grandparent, grandchild, aunt or uncle, niece
or nephew or step equivalent.
The need for assistance must be likely to continue for at least two years.
An assessment of the Australian
relative's medical condition must be made by Health Services Australia (HSA).
Evidence that the Australian relative has arranged a medical examination with
HSA must be provided with the application.
Sponsorship: All applicants in the Other Family category, whether
they apply within or outside Australia,
must be sponsored. The sponsor must be either an Australian citizen, Australian
permanent resident or eligible New
Zealand citizen, and would usually be 18
years of age or older.

SPOUSE/FIANCEE VISA

Partner Visa
Partners of Australian citizens, permanent residents or eligible New Zealand
citizens are required to apply and be assessed against the laid down criteria
for the grant of a partner visa.
Australia Partner Visa scheme has three categories for partners of Australian
citizens, permanent residents or eligible New
Zealand citizens wishing to migrate to Australia.
Australia's Partner migration programme permits for the subsequent grant of a
visa that permits spouses, de facto partners and interdependent partners
(including those in a same-sex relationship) to enter and remain permanently in
Australia.
Fiancée Visa (Australian Prospective Marriage Visa)
Applicants must be living outside Australia and be engaged to be married to an
Australian citizen, permanent resident or eligible NZ citizen, and wish to
marry that person in Australia. This means applicants cannot apply for a
fiancée visa if you are in Australia.
Applicants must be able to demonstrate to the Department that they have genuine
intentions to marry their fiancée, be committed and be prepared to live
together as spouses.
Applicants are also assessed on
their character and public health. In addition, an assurance of support may be
required if there is a dependent child or children included the application.
Spouse Visa (Australian Spouse Visa)
Applicants must be in a married or a de facto relationship with an Australian
citizen, Australian permanent resident or eligible NZ citizen. They can apply for
this visa in or outside Australia.
If they are living overseas and are engaged to be married to an Australian
citizen, permanent resident or eligible NZ citizen, and intend to marry their
spouse before entering Australia,
they can apply for a spouse visa but they must marry their spouse before a
spouse visa can be granted.
They must be able to prove to the Department that their relationship is genuine
and sustainable.
With the exception of a couple who
can establish that they have been in a long term spousal relationship applicants
must first obtain a provisional visa granting temporary residence. They may be
granted permanent resident after two years depending on whether they are able
to meet further criteria of the Department.
Interdependent Partner (Australian Interdependent Visa)
To be eligible for this visa applicants must be in an interdependent
relationship with an Australian citizen, permanent resident or eligible NZ
citizen . Interdependent relationships include same sex couples.
Applicants can apply for this visa either in or out of Australia. Applicant
need to prove to the department that the relationship is genuine and likely to
be sustainable.

CHILD VISA
AllWorld Migration Services
This visa permits Australian citizens, Australian permanent residents and
eligible new Zealand
citizens to sponsor their children to live permanently in Australia. The child can either be a biological child or
an adopted child.
The parent (sponsor) is responsible
for lodging the visa application on behalf of the child. The child must be
under 26 years of age.
This visa allows the visa holder to:
• live permanently in Australia
• travel to and from Australia
for five (5) years from the date the visa is granted.

PARENT
VISA
AllWorld Migration Services
This visa permits parents of Australian citizens, Australian permanent
residents and eligible New Zealand
citizens to live permanently in Australia.
These parents need to be sponsored by
their children. There are two types of visas for parents wishing to migrate to Australia:

Aged Parent Visa
Both parents visas have similar visa requirements. The major difference is applicants
for the Contributory Parent visa must make a significant contribution to their
future health and welfare costs. The Contributory Parent visa category is a 2
year temporary visa.
Temporary Contributory Parent visas holder can apply for a permanent
Contributory Parent visa after living in Australia for a while. Both parent
visas are capped however there is a higher number of places for Contributory
Parent Visa applicants than Parent Visa applicants. It also has a higher processing
priority than parent visa.
Other requirements are Public Interest Criteria: (Health and Character (Police Clearance)). An Assurance of Support and bond must be provided.
What is Balance of Family Test
The number of children of the parent who are lawfully and permanently resident
in Australia or are eligible New Zealand citizens usually resident in Australia
is:
(i) greater than, or equal to, the total number of children of the parent who
are resident overseas; or
(ii) greater than the greatest number of children of the parent who are
resident in any single overseas country.
Aged parents:
for men the qualifying age is 65 years.
